Motorbike riders involved in the Interstate 11 (I-11) shootings may now face gang-related charges following a ruling by the Nevada Supreme Court. This decision shifts the legal landscape for criminal cases involving motorcycle clubs in Nevada. The riders were previously not subject to this sort of legal scrutiny.

The case originated after a string of violent incidents that took place on the I-11 highway. Representatives of two rival motorcycle clubs, the “Vagos Motorcycle Club” and the “Hells Angels Motorcycle Club” encountered each other, leading to gunfire. Following the incident, the court came to a decision that the oppressive laws traditionally applied to street gangs could also be valid in the context of violent incidents involving motorcycle clubs.

In the ruling, the state’s highest court overturned a district judge’s decision. An earlier ruling had dismissed gang-related charges against eight bikers due to insufficient proof that the Vagos Motorcycle Club was a criminal gang. In the new ruling, the Nevada Supreme Court judgement stated that the state law defines gangs in a way that could certainly encompass such motorcycle clubs.

Legally, the Supreme Court ruling suggests that if a club’s wider activities include crime and violence, even members not directly involved could potentially face criminal charges. This decision could have significant implications for the handling of future cases involving motorcycle club members in Nevada. Still, the court made a point to note that the ruling is not a categorical declaration that all motorcycle clubs are gangs. “We do not hold that motorcycle clubs are criminal gangs,” the justices clarified.

While the decision may contribute to broader discussions on how states interpret street gang laws and apply them to motorcycle clubs, it remains specific to Nevada. This ruling leaves it to the discretion of future courts whether a motorcycle club qualifies as a gang under Nevada law.
